
Please read these Official Rules carefully as they will affect your rights if you participate in this public and patient awareness program.
1. The Calendar Campaign: The nonprofit Psoriasis Cure Now (“PCN”) is seeking persons with psoriasis or psoriatic arthritis to have their pictures and personal stories included in its 2009 PCN Calendar. PCN will use the calendar to educate the public about the as many as 7.5 million Americans who have psoriasis or psoriatic arthritis, and to inspire other psoriasis patients. PCN will also use this calendar to advocate for additional research on psoriasis. There will be both a physical (paper) calendar and a web-based calendar.
2. Agreement to Rules: By submitting an application to this campaign, you agree to all of the rules. All decisions regarding the campaign will be made by PCN in its sole discretion, and are final.
3. Eligibility: Applications may be submitted only by individuals who are legal residents of the United States and the District of Columbia. Persons who are younger than 18 years of age must submit permission from their parents or guardians before their application will be considered.
4. Originality and Rights: PCN will own all rights in the calendar, including all rights to all the material submitted to it in connection with this campaign, whether or not the information is ultimately used in the calendar itself. Any information, photos, or other material you submit to PCN as part of the application process or the calendar campaign becomes the property of PCN, and you agree to allow PCN to use your name, identification, biographical and personal information, and likeness to use, promote or publicize its calendar and programs in any manner, without limitation, and without further compensation. You recognize that this campaign and other PCN programs involve public education and discussion, and you expressly waive any privacy or similar statutory or legal rights in the materials you submit, including any personal or biographical information, to the greatest extent possible under applicable laws. You agree to indemnify PCN, including for legal costs, against any challenges to the ownership, use of, or rights to material you submitted. You also agree that the material you submit, including photos, is original to you and is not owned by any other person or entity, and that you have the rights to transfer all rights in the material you submit to PCN.
5. Your Application: You must apply by filling out the application on the PCN website at: http://psoriasis-cure-now.org/calendar/submit.html . You must fill out the application completely, accurately and truthfully, including attaching a personal photograph in one of the available formats. Any material you submit, including photos or additional biographical information, must be appropriate to the subject of the calendar and not offensive, sexually-oriented or defamatory in any way. Your submitted material must focus on your psoriasis or psoriatic arthritis, or otherwise illustrate the effects of this disease. Please note: if we select you for inclusion, you will be publicly identified as having psoriasis and/or psoriatic arthritis; while we believe that everyone will be helped by educating the public that people with psoriasis are family, friends, neighbors – people just like other Americans – before submitting your application, we urge you to seriously consider the consequences of public disclosure of your condition.
6. Initial Selection: PCN will choose some of the persons who submitted applications to the calendar campaign for further consideration. The number of applicants selected depends on the number of qualified applications. Please understand that we expect that more people will apply than we can include in our calendar or programs; PCN, in its sole discretion, will determine which applicants to include, and even being requested to provide more information or having a PCN photographer take photographs does not guarantee inclusion in the calendar.
7. Responsibilities of Selected Applicants: Applicants who are selected by PCN for further consideration will be requested to: a) sign releases for all material submitted or produced in conjunction with this campaign; b) submit additional information as needed, including further biographical and personal information; c) schedule photographic sessions with PCN-selected photographers to obtain commercial-quality photos; d) schedule interviews with PCN writers or editorial personnel for further material, including profiles for the calendar or other programs; and e) cooperate with PCN in obtaining publicity or public education campaigns, including media appearances and possibly travel to other areas. An applicant who does not satisfy these requests or who is otherwise non-cooperative will not be included in the calendar or other programs.
8. Deadline for Submission: Applications should be submitted as soon as possible, and slots may be filled by August 15, 2008. Applications will be accepted beyond that date but note that the 2009 calendar slots may be filled by that time; however, we will review your application and look for other ways to involve you in educating the public about this disease.
9. Additional Conditions and Terms:
A) As a condition for submission, you agree to release, waive, indemnify, and otherwise hold harmless PCN and all persons associated with it from any liability associated with your application, submitted materials, and this campaign to the fullest extent of appropriate state or local laws.
B) Submissions will not be returned.
C) PCN is not responsible for errors of any kind, technical hardware or software failures of any kind, including any injury or damage to any person's computer, related to or resulting from participating in or experiencing any materials in connection with this campaign. PCN reserves the right to cancel or modify the campaign if fraud, misconduct or technical failures harm the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the campaign as determined by PCN, in its sole discretion. Any use of robotic, automatic, programmed or like methods of participation will void all such submissions by the applicant.
D) PCN reserves the right to cancel or modify the campaign for any reason, as determined by PCN, in its sole discretion. In the event of termination, a notice will be posted online.
E) PCN may use any and all information obtained from participants for its internal activities, including contacting an applicant. PCN may share this information with others, but will not sell this information to others. Please review our privacy policy for more information.
F) This campaign is governed by the laws of Maryland. All claims relating in any manner to this campaign or to any submission must be resolved in the federal or state courts of Montgomery County, Maryland. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of participants and PCN in connection with the campaign, shall be governed by and construed in accordance with the laws of Maryland, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Maryland.
G) PCN is not responsible for any typographical errors in these Official Rules, in announcements related to the Calendar Campaign, or in the Calendars themselves.
